Privacy notice

Solertia Abogados, S.C. (the "Firm"), a Mexican civil partnership operating under the trade name "Alarcón Law", with its address at Bosques de Radiatas 44, offices 403 and 404, Bosques de las Lomas, Cuajimalpa de Morelos, 05120, Mexico City, is the data controller of the personal data you provide through alarconlaw.com (the "Site"), pursuant to the Mexican Federal Law on the Protection of Personal Data Held by Private Parties published in the Federal Official Gazette on March 20, 2025 (the "Law"), and other applicable provisions.

For the purposes described in this notice, the Firm collects the following categories of personal data:

(a) Identification and contact data: name, email address, telephone number and, where applicable, company or organization and position.

(b) Data concerning the matter you describe when sending a message, scheduling a consultation or subscribing to our communications.

(c) Browsing data collected through cookies and similar technologies, as described in Section 8.

(d) Data contained in documents you choose to share with the Firm.

The Firm does not request sensitive personal data through the Site. Please refrain from sending sensitive, financial or proprietary data, or any confidential information, until the Firm confirms in writing that you may do so, as provided in the Site’s Terms of Use.

Primary purposes, necessary for the legal relationship with you: (i) responding to and following up on your inquiry; (ii) performing conflict-of-interest checks; (iii) evaluating your matter and, where applicable, entering into the corresponding professional services agreement; (iv) providing the legal services engaged; (v) billing, collection and administrative management; and (vi) complying with the Firm’s legal and professional obligations.

Secondary purposes, which require your consent: (i) sending you the Firm’s newsletters, publications and event invitations; and (ii) sending you informational or promotional communications about the Firm’s services. You may refuse or withdraw your consent for these purposes at any time by writing to alarconabogados@alarconlaw.com or by using the unsubscribe link included in each communication, without affecting the handling of your matter.

Where the provision of services requires the processing of sensitive, financial or asset-related personal data, the Firm will obtain your express consent and, in the case of sensitive data, your express written consent, through the professional services agreement or the corresponding instrument. Such data is processed under strict security and confidentiality measures, including attorney-client privilege where applicable.

The Firm relies on service providers that process personal data on its behalf and under its instructions (data processors), such as website hosting, email, messaging, analytics and artificial intelligence tools used as operational support. Some of these providers may be located outside Mexico, mainly in the United States of America. In all cases, the Firm requires its processors to undertake confidentiality and security obligations consistent with this notice and with the Law.

Beyond the foregoing, the Firm does not transfer your personal data to third parties without your consent, except in the cases exempted by the Law, including requests from competent authorities and transfers necessary for the exercise or defense of legal rights.

You may ask to be included in the Firm’s exclusion list, in order to stop receiving communications for secondary purposes, by writing to alarconabogados@alarconlaw.com. You may also limit the use of cookies as described in Section 8.

You have the right to access your personal data, rectify it when it is inaccurate or incomplete, cancel it and object to its processing (the "ARCO rights"), as well as to withdraw any consent you have given us. Exercising these rights is free of charge.

Requests must be submitted to alarconabogados@alarconlaw.com or at the Firm’s address, and must include: (i) your name and a means of receiving our response; (ii) documents evidencing your identity or, where applicable, your legal representation; (iii) a clear and precise description of the data concerned; and (iv) any element that facilitates locating the data.

The Firm will communicate its determination within a maximum of twenty business days from receipt of the request and, if the request is granted, will implement it within the following fifteen business days.

The Site uses strictly necessary cookies, which remain permanently active. Analytics and preference cookies are installed only with your prior consent, given through the Site’s settings panel, where you may also withdraw it at any time. You may additionally disable cookies in your browser settings, on the understanding that this may affect the functioning of certain sections of the Site.

The articles, blog posts, publications, newsletters, videos and frequently asked questions available on the Site are provided for general informational purposes only; they do not constitute legal advice, nor a recommendation or legal opinion applicable to any specific matter. Submitting personal data through the Site, subscribing to the newsletter or reading such contents does not create an attorney-client relationship with Solertia Abogados, S.C. That relationship, and the advice deriving from it, exists only upon the execution of a professional services agreement, as provided in the Site’s Terms of Use.

If you believe your right to the protection of your personal data has been infringed, you may file a complaint with the Secretaría Anticorrupción y Buen Gobierno (Ministry of Anticorruption and Good Governance), the competent authority for the protection of personal data held by private parties in Mexico.

The Firm may amend this notice to reflect legislative or judicial developments or changes in its data processing practices. Any amendment will be published at alarconlaw.com/en/privacy-notice, indicating the date of last update. We encourage you to review it periodically.

This notice is a courtesy translation. In the event of any discrepancy, the Spanish version published on the Site shall prevail. Last updated: September 2026.
